Terms of Use

These Terms of Use govern your access to and use of the GemsRoute platform. By creating an account or using any part of the service you agree to these terms. If you do not agree, do not use the platform.
1. The Service
GemsRoute provides a diamond traceability platform that allows authorised dealers to register stones and end users to verify gemological data and manage ownership claims. The service is provided on an as-is basis and may be modified or discontinued at any time with reasonable notice.
2. Accounts
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information when registering. You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these terms.
3. Dealer Obligations
Authorised dealers who access the platform via API or dealer panel agree to: (a) register only stones they are entitled to register; (b) ensure that all submitted data is accurate and does not infringe third-party rights; (c) not include personal data of any natural person in fields that are or may become publicly visible; (d) comply with all applicable data protection laws, including KVKK, in their use of the platform.
4. Prohibited Use
You must not: use the platform to register stolen or fraudulently obtained stones; submit false or misleading information; attempt to reverse-engineer, scrape, or disrupt the platform; use automated tools to submit verification searches at rates exceeding the published rate limits; or attempt to identify stone owners from publicly visible data.
5. Intellectual Property
All platform content, software, and branding is owned by or licensed to GemsRoute. You may not reproduce, distribute, or create derivative works without prior written consent. Stone data submitted by dealers remains the property of the submitting organisation; by submitting data you grant GemsRoute a licence to store, display, and process it for the purposes of the service.
6. Limitation of Liability
GemsRoute is not liable for: the accuracy of gemological data submitted by dealers; the outcome of ownership claims or dispute proceedings; losses arising from reliance on verification results; or service interruptions. To the maximum extent permitted by law, our aggregate liability is limited to the fees paid by you in the preceding twelve months, or €100, whichever is greater.
7. Termination
You may close your account at any time by contacting us. We may suspend or terminate your access immediately if you breach these terms, if required by law, or if we reasonably suspect fraudulent activity. On termination, your right to use the service ceases and we will handle your data in accordance with our Privacy Notice.
8. Governing Law
These terms are governed by the laws of the Republic of Turkey. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of Istanbul courts, unless mandatory consumer protection law in your country of residence provides otherwise.
